You will not disclose or use any news, information or data except for a permissible purpose. ENL makes no representations concerning your permissible purpose. 
7. MISUSE AND ELECTRONIC ACCESS. If any concern about misuse occurs, you will fully cooperate and provide any or all information to ENL as it designates in its sole discretion. ENL reserves the right to cancel any agreement with you of any kind immediately without any recourse by you of any kind if ENL believes in its sole discretion that its services are used inappropriately or in any manner it dislikes. 
8. NO WARRANTIES, DEFECTS AND ASSUMPTION OF RISK. You accept all news, information and data on the site or from ENL in the condition provided: “AS-IS.” ENL does not guarantee the accuracy, reliability, completeness, current, or factual status of the news, information or data on the site or from ENL in any manner whatsoever. ENL disclaims ALL representations and warranties regarding the site and services including all warranties of merchantability or fitness for a particular purpose, quiet enjoyment or non-infringement. ENL does not guarantee or warrant the fitness of any news, information, data or files for download. ENL does not ever represent, guarantee or warrant files will be free of defects, timely or uninterrupted. You assume ALL risks associated with use of the site and news, information or data from the site or from ENL including risks of quality, security, availability, performance, accuracy, reliability, and completeness of any information on the site or from ENL. Third-party companies may use cookies or tags. Any information collected by these third parties is not under ENL’s control. ENL assumes no responsibility or liability for such activities. ENL is NOT responsible in any way for the goods, services or conduct of any linked or related sites, or advertisers. 
9. DAMAGES AND LIABILITY LIMITATIONS. You agree that ENL is not liable for any errors, omissions, or inaccuracies related to content of any kind whatsoever on the site or from ENL. ENL is NOT liable for any damages whatsoever including any direct, special, incidental, consequential, exemplary or indirect damages, and not limited to lost profits, business interruption, loss of programs or information, or any similar or other damages arising out of use of or inability to use the site, news, information or data whether from ENL, or of any other claim of yours or by third parties, of any nature whatsoever. You agree that any liability of ENL, if at all, in connection with use of the site, news, information or data, is limited to fees paid by you, if any, one-year immediately preceding any alleged damage, excluding attorneys’ fees, other costs or expenses, in jurisdictions where this is permitted. Your use of this site requires the express, written approval of ENL and is governed by California law superseding its conflict of laws provisions subject to a one-year statute of limitation from the date of an alleged injury, regardless of any other statute of limitations. Any such action shall be filed in the Superior Court State of California, County of Los Angeles, or the U.S. District Court Central District, 9th Judicial District. 
10. INDEMNIFICATION. You shall indemnify and hold harmless ENL, its officers, directors, employees, agents, and entities that have contributed information to or provided services for ENL, against any and all direct or indirect losses, claims, demands, expenses including, but not limited to attorneys’ fees, or liabilities of any kind whatsoever including use or distribution of any news, information or data obtained on the site or from ENL.

12. COMMENCEMENT OF AGREEMENT, SURVIVAL OF TERMINATION. Any agreement with ENL begins with your acceptance of each of these Terms & Conditions and is then subject to the specific written approval of ENL, at its sole and absolute discretion, whether or not ENL has allowed prior access or use of the site or any information from ENL. ENL reserves the right to refuse to offer or may cancel any agreement under any circumstances and at any time it deems necessary in its sole and absolute discretion. Any such agreement is non-transferrable and exclusive for the specific and limited permissible uses set forth in Paragraph 1 above and is subject to the terms of Non-Disclosure set forth in Paragraph 6 above. This agreement shall continue until terminated by either of us upon notice by email, which must be acknowledged by ENL. However, Paragraphs 2, 3, 4, 5, 6, 7, 9, & 10 herein survive termination. 
13. STRICT PERFORMANCE AND ENTIRE AGREEMENT. Failure by ENL to insist on strict performance of any terms & conditions shall not waive future enforceability of any such or other term(s) or condition(s). The terms & conditions set forth herein are the entire Agreement. Any additional or different terms or conditions set forth in any other document have no force or effect unless accepted and approved by ENL at its sole discretion.
